Natural Justice

Dear Friends,

It seems to me, dogs embody justice and fairness innately. They recognize unjust treatment and act accordingly. Anyone with more than one dog has witnessed their sense of justice. This proves that justice is a state of nature. Dogs are as close to nature as you can get. Therefore, Thrasymachus’ version of justice is a perversion. That’s why we are revolted at it. Especially when we are treated to the spectacle of our “justice” system following Thrasymachus’ theory… that justice is the advantage of the strong over the weak. Our revulsion shows that Thrasymachus’ ideas are not simply wrong… they’re unnatural. When viewed with perspective they land in the midst of uncanny valley. This is why I believe that the ugliness of our present injustice system will be its own ruination.

Anyone who’s owned a dog understands they have a sense of fairness ingrained in them. There’s no time when this isn’t more pronounced than when treats are being doled out. They resent being left alone if another dog goes in the car, and if you watch them close enough, they even recognize injustice between people. Since a dog is pure nature, there’s no pretense… they show us what the state of nature understands. Clearly, judged by a dog’s sense of fairness, justice isn’t a human idea it predates us since even dogs understand it innately. Moreover, the concept of justice or the idea of it is so ingrained in us that even the worst villain has to justify their actions in their own mind. Because I’m sure the Death Camp Guards at Dachau understood they were the good guys.

If animals have justice as genetic programming then justice is a state of nature. Thrasymachus’ view that justice serve the strong then must be a perversion. A human perversion that allows theft without consequences. As Bastiat said in his book The Law. History, however, shows us that mankind is not capable of just action. As Carneades said, ‘people like animals each strive for their own self interests…’ which in and of itself isn’t so bad. Unless wide imbalances of power are allowed to build up. Then law can serve the powerful at cost to the weak. The greater the imbalance of power the more law and “justice” serves the powerful. In the state of nature imbalances of power seldom exist and when they do so also does injustice. As in chimpanzee troops, injustice usually ends in extreme violence.

Perversions are always ugly… that’s why they are done in darkness. The courts that rule against justice do so behind curtains of rules debarring the public from filming, recording or in some countries even reporting on their perversions of justice. Wasn’t that what one of the arrests of Tommy Robinson was all about? He reported on a court case. Governments use national security as an excuse to sweep many crimes under the rug. Moreover, what politician, lobbyist, or bureaucrat would tolerate their every word recorded and broadcast instantly over the internet for everyone to see. They require darkness for their machinations to work. That’s how we can identify when injustice is happening… when it’s shrouded in darkness. Censorship then is a sure sign of Thrasymachian logic being applied.

Our courts today epitomize the idea that law should benefit the strong at cost to the weak. From our lawyers and judges, with their obvious double standards, our courts and law enforcement epitomize the Thrasymachian ideal. That’s why we are so revolted by them. They’re like a corrupted corpse… they used to be something, but now they’re just disgusting. That’s why they stay hidden in the dark. The trouble is, social media and the new press has shone a light on them. It’s exposed them eating brains in the dark and like cockroaches they scramble into the shadows. That’s made our innate sense of justice recoil at the obvious injustice masquerading as law. Dogs understand justice, so justice isn’t a human idea… systematic injustice is.

Sincerely,

John Pepin
