Human Heartedness and Government

Wednesday, August 4th, 2010

Dear Friends,

It seems to me that to hold another person to a higher standard of personal conduct than one holds himself is not human hearted. To be “not human hearted” in this way, historically, qualifies a person to hold public office.

For all of human history people in power have never been held to a standard of personal conduct that is close to the demands placed on the people. The ancient Greeks with the temporary ostracism, and Romans with the Censors made gestures in the direction of holding powerful people to standards. But those two systems were flawed in that they still hadn’t solved the problem of power of personality or cults of personality.

The ancient Greeks ostracism was a direct attack at charismatic power. If an aristocrat would get too powerful the people would call a vote. They would write yea or nay on a piece of pottery or ostrakon
and count the vote. If the ayes had it the person was sent away for a few years to let his partisans cool and his charismatic power to wane. His possessions were kept safe as were his family and slaves. When he returned he could participate in public life again. This practice visited any number of catastrophes on Athens. From Pericles (with the misshaped head) to Alcibiades the ostracism was a wash.

The Romans had the Censors. Powerful aristocrats that had draconian powers to look into the personal dealings of other aristocrats. Unfortunately with no effective public oversight the Censors used their offices to garner bribes and indulgences from the powerful people they were supposed to regulate. An early form of regulatory capture. Both pernicious and both inevitable if the conditions are right. Human nature being what it is.

Human nature is unchangeable. When faced with the choice of; Let someone burn you with a cigarette and they will give a million dollars, to charity the charity of your choice, for each hour of torture. No one would submit to it. Unless they were sadomasochistic. Despite the obvious societal good from the windfall to charity…. But give another that choice over someone else and the perspective is widened considerably. They would have no problem with this Faustian bargain. The fact that they feel no pain when the cigarette is applied is irrelevant. Or so they will say. It is universal and it is human nature.

To decry human nature is foolish as it is to decry gravity. Without it we could not exist as we are. The wise lawgiver looks human nature in the eye and works with it. Doesn’t try to change it in others while waxing his own.

That has been the problem with governments through the ages. The Elite try to force others to live as the Elite wish and the Elite live as they wish too. This sets up a fundamental tension in human governments. That tension is the underlying energy source for class struggle.

The ancient Chinese had it close. Despite their arguments and the internecine squabbles of the States the Chinese philosophers in classic times had it by the tail. That their governments ignored the good teachings and embraced the bad is just a function of human nature….

Perhaps, if some nation at some time held their leaders to the same standards they hold the people to, this fundamental tension would be relived. So maybe, to be not human hearted should disqualify a person from public office.

Individualism vs Egoism

Thursday, July 29th, 2010

Dear Friends,

It seems to me that when a millionaire ten times over says he or she will hurt the rich and help me… I know I am being lied to. Because for a rich person to hurt the rich violates human nature. They would have to hurt themselves. No one hurts themselves… No one. Unless they are mentally deranged. I hope not many of our lawmakers are mentally deranged… but their actions an the other hand…

John Kerry is a perfect example. He went to New Zealand to buy a 7 million dollar yacht. (Apparently he doesn’t like union workers in Massachusetts). Then he moored it in Rhode Island to avoid paying the five hundred thousand dollar sales tax bill and the seventy thousand dollar a year excise (luxury) tax, (that Kerry supports). Here is an example of a man who claims to help the poor by hurting the rich. I.e. Raising taxes on the rich. Apparently he doesn’t believe himself rich… People who have exponentially less money then him are rich. Their taxes are going up. But the billionaire is not.

The best part of this story is that a reporter asked Kerry; if he docked the boat in Massachusetts would he have to pay the Massachusetts tax then. Kerry responded, “It depends on who owns the boat.” [A very rare example of honesty in a lawgiver.]

The premise of this statement is that some people are subject to taxation and others are not. I ask you… What incentive does this set up in society? Where the people who set tax law are not held to that law? Is it likely, self interested, human beings will keep tax law fair if they are not subject to it? Of course not.

It is not human nature to hold the interests of others as high as one hold’s his or her own. In this instance Hsun Ching is correct that the congenital nature of Man is evil… Self centered. Philosophies that hold human nature to be wrong and force whatever the Elite believe, today, is “virtue” are flawed. To have at the core of a philosophy of ruling people a premise that is diametrically opposed to human nature is like building a gasoline motor and trying to run water in it. It is flawed. Not the motor… or the water… just that they will not work together.

Over and over we have examples of why people cannot self police yet we staunchly believe that the Elite will violate human nature. I.e. be un-self-interested. Even when we have grievous examples like the one above before us many say; “so what.” To them tomorrow is a white fog. Impossible to predict and mysterious as a Stephen King novel. I dare say too many people are of this persuasion. When the fruit of their nonchalance is visited on them they will lament that it was unforeseeable.

“How could this possibly have happened? I voted for the same people over and over but things never got better. They only got worse and worse.” is the lament of the willfully ignorant.

Another sophist argument that I hear and am dumbfounded at is that I personally have it ok now so why worry about the future. To make this argument and believe it a person must live in a one dimensional world. A point in time with no past no future, and no other possibilities then what is.

I love the way de Tocqueville called American individualism as opposed to egoism; “The doctrine of self interest rightly understood.” What a beautiful way to explain the truly civilized person. Someone who understands that sometimes we have to subordinate immediate gratification for long term gratification. To understand that self interest is intricately tied to societal interest. And that safe streets are in our own best interests. Of course the progressives are working to undermine this character trait in the American ethos.

The Elite are not held to the law in most places and times on the Earth. Their self interest need not be rightly understood. If they are not subject to a law will they give it the same scrutiny that they would if they were subject to it?

The modern Elite (progressives) seek to change people from individualists to egoists. Then the egoists will willingly forge the chains for the Elite and even bind themselves with them. Egoism is stupid self interest. It requires that one not think critically about our leaders. An egoist lives in a singularity. Egoism makes a person think a job flipping burgers is beneath him but being on the public dole is honorable. An egoist believes that the world owes him or her. An egoist calls another greedy because he doesn’t want to give more of his hard earned money to the lazy egoist but the egoist will scream like a scalded cat if a dollar of his money is missing.

By the way… did you hear about Barney Frank flipping out over not getting a senior citizens discount that he was not entitled to?

It cost him an extra dollar for the ride.

The Congenital Nature of Government

Sunday, March 21st, 2010

Dear Friends,

It seems to me that the congenital nature of government is evil. But before we can consider that government is evil we must first consider what definition of evil we will use.

In this instance we are not arguing that government is demonic. Or that it is controlled by some supernatural malevolent force. In this instance we are using secular definitions of evil only. The malevolent force is human.

Hsun Ching argued the congenital nature of Man is evil. His definition of evil was that evil is chiefly characterized by profound selfishness and self centeredness. He went on in his logic to claim the goodness in us is a learned trait. His definition will work quite well for our usage. In the case of the congenital nature of government we will define evil as pure self centeredness. Without regard to others.

How is government born? Almost every government that has ever come into existence has done so by violent means. Non violent revolutions are very infrequent and often are short lived before some strong man takes over… violently. People not used to liberty quickly vote it away for mere baubles.

Government is born of violence and government exists by violence. That creational violence is always followed by reprisals for past violence. Government uses violence so much we don’t even notice. Every police action is violent at it’s soul. Government sponsored violence. Violence done to the individual for some perceived societal good. Seldom are other enticements offered by government. Violence is the main tool in government’s tool box.

What if you or I refuse to pay taxes? If we are adamant about it we will have our homes assaulted in the middle of the night by armed government agents. Like in New Hampshire. Violent means will be used on our person to extract money for government to use to some other evil end. Committing violence on some people on the other side of the world.

Even when government seems to be benign… it is evil. Government will “help” this or that group that the Elite want to garner political favor. How does government do this? By violently taking the property of one and giving it to another.

If it is wrong for an individual to put a gun in my face and force me to give money or property… why is it good for government to do worse? One black dot being seen as black but many black dots seen as white. Are our collective eyesights that bad?

Those that advocate for total government, progressives, communists and socialists, always want a draft. They love the idea of coerced servitude to government in the form of military service. They decry a volunteer force. Because a general requirement for military service gives them colossal powers. Power to defer politically connected sons and daughters from service (to political ends). Power to threaten anyone with forcing their son or daughter into military service if they don’t do as ordered. There is no end to the mischief that can be done when the Elite have a general draft.

Moreover I never understood and still don’t, how a person can have a pitifully low opinion of his fellow man. Such that they believe that he should not be trusted with arms. His free speech should be limited by a fairness doctrine, his decisions should be made for him by government, and that he is so corrupt he cannot be trusted in any way without government oversight… can possibly believe that people in government can be trusted at all? How does that jibe? If all people are corrupt, stupid and menacing, how can you believe that people can be trusted with unlimited power in government? These people always protect the caprice of power. They defend corruption in government but decry it in the private sector.

Government holds others to a much higher standard then it does itself… in every way. Not only in outright corruption but in personal behavior as well. Politicians daily get away with personal conduct that would land you or I in jail. Running a prostitution ring from one’s apartment for example. Ignorance is no excuse under the law… unless you write that law.

What is more selfish than holding others to a much higher standard than oneself? Therefore, what, is more evil?

Lawyers and Society

Wednesday, November 11th, 2009

Dear Friends,

It seems to me that Lawyers are little more than parasites on the corpus Humana. The job of an attorney is to facilitate transactions between people to allow capitalistic enterprise to work. Attorneys have discovered however that if they throw roadblocks, loop holes, and sue whenever they can, they make far more money.

So Lawyers have eschewed their true function in society and have instead taken the path governed by greed. Not greed that is channeled to help the lot of man but greed that profoundly negatively affects the lot of man. As attorneys are complaining that big oil makes too much money… one year it was $30 billion dollars. That same year, lawyers made well over $100 billion, after tax. Lawyers complain that the health care system should be socialized using the single payer model but are in far more need of being reigned in than any doctor. Moreover Lawyers are fond of calling others greedy. (What else is the premise of the argument that “pay for services” cause doctors do too much testing)? When in fact they are the most greedy people on Earth! They feed their greed at the cost to mankind!

Every time a judge finds that a criminal who cuts his arm breaking into a person’s home is entitled to damages they create more demand for attorneys. Every time a judge finds a loophole in a solid contract they create a greater demand for lawyers. Every time a judge finds that I am liable for your action they create more of a demand for attorneys. Every time a legislative body requires more paperwork and regulations for business to work they drive the demand for attorneys. All of which drives up the cost of doing business and therefore slows business (job) growth.

The legal justice system in the US feeds the greed of today’s modern lawyer. An advocate they are… no more. Divorce lawyers keep former lovers at each others throats. Instead of giving up a $100.00 item lawyers will encourage their victims to pay them $1,000 to fight for it. All the while saying they are basically a plumber who charges by the hour.

What plumber could come into your home to fix a leak, break every faucet in your home, even ones that didn’t formerly leak, charge you five times his quote and act like you are a jerk? Lawyers would tear him to pieces. But they don’t have any oversight. They are self governed.

If self government is such a good idea for the Elite (lawyers) then why not for the rest of us? For a law to be valid it must be universally valid. If we cannot be trusted to self govern then how much more those that govern us?? Self government does not work because, as Hsun Ching said, “mankind’s congenital nature is evil.” in that we are self indulgent and our self indulgence is learned away.

Maybe before we destroy the health care industry in the US we should look into creating a single payer system for lawyers? Why should rich people be the only people who can afford to protect their property in a lawsuit? Why is it that only rich people should be able to use the legal justice system to drive their own personal agendas?

Like shutting down progress they don’t like. Road building has become exponentially more expensive since trust funders have their lawyers suing in environmental court. A road was ready to be constructed in Vermont a few years ago, the machinery was on site and initial construction had began, and some judge shut it down. He claimed an environmental study’s timeframe had elapsed (because of the incessant lawsuits that took years to wind through the courts) and the road project must be stopped. Tens of Millions of dollars was wasted…. But what the judge really meant was, “we lawyers haven’t sucked enough money from this project yet. So you must waste millions of dollars of taxpayer’s hard earned money so we can be further enriched!”

That is the definition of a leech if you ask me. Leeching off the labor of those that produce. The legal system in the US is as much friction to the right ordering of society as are all the criminal acts combined. They suck money from the system and waste it just like government. Together Lawyers and government provide a huge weight holding back the working man and woman in this country. But working people mean nothing to someone making $200.00 an hour to destroy people‘s lives.

So yes, I believe that lawyers in the twentieth century, an masse, have decided to go for the gold. Instead of helping society function they hinder it. Making more money even as they deserve less. But when your faction controls the presidency, the legislative bodies and the Supreme Court you have some clout! Madison be damned.

Why We Need Lawyers

Tuesday, August 11th, 2009

Dear Friends,

It seems to me that the reason we need lawyers in our society is that people don’t want to be held at their word. It is Hsun Ching’s maxim that the congenital nature of man is evil. By evil he meant purely selfish. Selfishness is our natural state. The civilization in us is learned.

Our civilization is learned and our selfishness is nature. The problem arises in that every incentive in our society promotes our being selfish and prevents us from being good. Take for example the child who, being a child, is out door throwing rocks. When he accidentally throws a rock through a window. The good child marches himself to the door, knocks on it and announces that he accidentally broke the window. The negative consequences flow from that virtuous act. Loss of outdoor privileges, possibly a spanking enmity from the victim of the rock incident and on and on. Now take the selfish child. He breaks the window and runs for it. If no one sees him he gets off scot free. There are no negative repercussions in his life. If he is caught he suffers no more, and probably less, than the virtuous child.

Especially the court system of the US promotes selfishness. Take for example the person who demands every right and privilege that could be afforded to him. That person enjoys a profound advantage over the person who goes along. The person who tries to be fair and honest in court is DOA. In the American court system perjury is not a high crime or a misdemeanor. It is nothing. The media and learned law professors were adamant about this point during the Clinton affair.

So if the incentives are set up to promote selfishness and our nature is selfishness then I wonder that any of us are civilized at all to any extent. The civilization in us is ground away. Yet we lament that some 20% of the population are sociopaths. They have absolutely no conscious. These people in our society have the advantage in any argument. They can screw over a friend for doing them a favor then expect him to pay for it. They are the avatar of selfishness. They don’t have the ability to see another’s point of view.

The fact is we are in a precarious situation. Our society depends on, at least some people, being honest and hard working. The problem of incentives goading people to abandon what they have learned is right must be fixed. Look at how sinuous and enmeshing the legal system has become. Like a vine that has overgrown the garden the US legal system has been fed and watered to the point that it has become a tangle that is quickly ensnaring our economy and our lives.

It is hard to hold people to any standard. We have been motivated by societal norms to be corrupt and selfish. All our lives we have been told to be good but encouraged to be corrupt. This tension passes through our entire civilization. Socrates argued against the Pre-Socratics, Rhetoratitions, and Sophists that it was the highest good to be a virtuous citizen. According to modern philosophers he won the argument. Well the argument might have been won but the battle goes on…
