The Faction that is Above the Law

Dear Friends,

It seems to me, it is becoming increasingly obvious, we live in a system where there is a faction that is above the law, and the rest of us are below it’s protections. Under any system where some are above the law, or below its protections, law does not exist but arbitrary rule is instead the character of the nation. Political favor is always the deciding factor in a country where arbitrary rule is the norm. Those with political favor, whether they be the tyrant or the oligarch, will never hold themselves to the laws they themselves make, those are for the little people. Moreover, the elite under such a system have carte blanche to punish those the elite see as a threat, regardless of the supposed limits on the elite’s authority. When it becomes undeniable that there are people who are above the law, like it has today in the US and Europe, unless we the people seek slavery, it is up to us to demand every member of the elite be held accountable. Giving a different faction that same power is self defeating.

No human being is an angel. We all know this but many of us operate like they don’t. Progressives willingly grant people with absolute power, in the misguided idea that if only the “right” person is in charge, the world will be utopia. That is the basis of every progressive argument. They see humanity as so hopelessly defective we simply cannot be trusted to run our own lives, yet they see the very same people, when they have absolute power, as saints who will work for the betterment of mankind. How many times have you heard a professor argue, real socialism has never been tried, or that, the wrong people were in charge then, when discussing the failure of socialism to ever elevate a single person, other than a member of the politburo, from poverty to wealth. Progressives constantly seek an angel to save humanity from itself. Sadly, angels only exist in heaven, and not in the common lot of Mankind.

The Obama administration was the most scandal ridden in US history bar none. Even the maligned Nixon paled in comparison to Obama’s antics while in office. From abusing his self proclaimed “political enemies” with the unlimited power of the IRS, trafficking arms to Mexican drug gangs, through this latest scandal where Obama wiretapped the phones of the other political party for political advantage in an election, not one of his scandals has yet to be investigated. There is not a single republican administration that would have weathered the fast and furious scandal, let alone wielding the IRS as a political weapon against progressives! It is undeniable Obama has openly broken many laws, and violated our Constitution in a myriad of ways, yet doesn’t even face an investigation for any of it… that is the definition of being above the law. Hillary Clinton wiped and destroyed a hard drive under subpoena, then lied under oath about it, even revealing Classified secrets to our mortal enemies! A felony if you or I did it, yet the FBI said no one would indict her for it, then indicted dozens of servicemen for far lesser crimes! Apparently servicemen are not politically favored.

There is not a soul who is the least informed that does not know that members of the government rarely subject themselves to the laws they write for the rest of us. From legal insider trading, to Congress’ exemption from the Affordable Care Act, the elite never hold themselves to the same standard they hold us to. Even the Sarbanes-Oxley Act doesn’t apply to the elite! They can lie without consequence to the American public at will. Get caught lying to the government and rest assured the elite will wield the entire power of the federal government to destroy you. Take the example of the socialist billionaire George Soros, he has used his vast wealth to conduct his own personal foreign policy, in violation of US laws that prohibit such actions from private citizens, yet he faces no penalty for it. Heck the geriatric Soros was even accused of beating his girlfriend, but the NYC police refused even to question him about it when the girlfriend made the accusation! Imagine what would happen to you, if your girlfriend went to the police accusing you of beating her! So, we can see that it is not only government officials that are above the law, but progressive billionaires as well.

Yet you and I are under the protections of law. The IRS scandal is one glaring example where citizens were denied justice and their due rights under the law for political purposes. The film maker who made the internet film, The Innocence of Muslims, which Obama blamed on Benghazi, a lie as it turns out, was jailed to promote the lie! So much for the First amendment’s freedom of speech. Try acting Pro Se in court, the lawyer against you will be held to a drastically lower standard of conduct than you, to the point of making the entire “justice” system absurd. If you run afoul of the bureaucracy, by violating some arcane regulation, you are denied the legal system to adjudicate your case, instead those regulations are made by the bureaucracy, enforced by the bureaucracy and tried by the bureaucracy. In the Federalist Papers Madison argued that if the laws ever became so many that even a trained attorney cannot understand them, then tyranny is in effect, showing that even by Madison’s definition, we live under a tyranny today.

When a faction is above the law that faction is the defacto oligarchy. Aristotle wrote in Nicomachean Ethics that there are three right forms and three wrong forms of government, The wrong forms have in common, they all serve the rulers not the nation state, or in Aristotle’s time, the city state. That faction today that is above the law, and indeed our very Constitution itself, as Nancy Pelosi so famously illustrated by her flippant attitude when asked if Obama care is constitutional, is the progressive faction. If we allow this to continue, or God forbid, give a different faction that same power, we are acting against the interests of our own children. We have to stand and demand, the elite are held to the law, and create a system to punish them when they violate our Constitution. Unless we act, we will be passing a world of suffering to our children. Look into the eyes of your children and grandchildren and ask yourself, do I want him or her to be a slave of some inhuman state? If you love them, maybe it’s time to enact a NUMA amendment, and proclaim to the world and our posterity, that no man is above the law and no man is below it’s protections.

Ideal Government

Dear Friends,

It seems to me, the entirety of my articles taken in the aggregate, are a road map of a nearly ideal government, pragmatically accepting human nature as it is, without the presumption of trying to change it. People are people, we want to collaborate, but we take advantage of the weak, we want to trade but we will take if there is no chance of getting caught, and we want equanimity but when our own interests are at stake, we balk at it. We are our own worst enemy, each and every one of us, any governmental structure must speak to our dualistic natures. Whenever possible, passive incentives rather than active measures should be put in place, to give everyone a stake in society. Since history is unambiguous about the outcomes of a free market versus a rationally controlled market, the free market must be as free as possible, to reap the greatest gain from it’s inherent abundance. Those who run government, always have been and always will be the greatest source of tyranny, their ability to usurp power to themselves must be sufficiently strong and have real teeth else no form of government, no matter how well constituted, can survive long. To that end I offer the Fourth Branch.

Our natures get the better of us all the time. Selling a house we might “forget” to mention there is a septic problem and when directly asked, simply lie. Then lament the huge extra costs of paying for a lawyer to do anything. If those around us are so corrupt, imagine how much more corrupt, those who pay no price for their actions and take no blame for any decision, are. Leaders have almost no incentives to remain virtuous and every reason not to be. Name them, power, sex, money, these are the worldly things that draw us into corruption. How much more magnified must the corruption be in our leaders than us, when they are caught doing things that put you and I in jail, but they skate with a standing ovation, a raise and another intern to abuse. Meanwhile churches, synagogues, fraternal organizations and others, give away food for the needy, provide for orphans, nurse the sick and help rebuild after catastrophe, all at their own costs. Human nature must be taken into account in any attempt to form an ideal government.

Since human nature is so mercurial, tending to corruption in a vacuum, oversight should be greatest for those at the top and least for those at the bottom. This is exactly opposite of what society does now. Today, our leaders have no oversight whatsoever, except themselves, while the rest of us are monitored incessantly. An ideal government would subject leaders to every law they pass on anyone, even, and especially if those laws don’t fit to lawmakers. Safety regulations for example, when a lawmaker crosses the parking lot to his waiting air conditioned limousine, he or she should, as a McDonald employee must, wear day glow green vest and a hard hat. Every regulation passed, must be applied to those who passed them, else there is no incentive to keep laws sane, and to pass the responsibility to a bureaucrat. Rather, if every law was forced on the lawmakers, including the President as he gets off Air Force One, wearing a safety helmet and day glow green vest flapping in the down draft, rest assured, laws would be very well thought out.

Active measures like law enforcement should be the last resort never the first in community problems. Most crime comes from a lack of a stake in society. Take away a child’s stake in society, or just blind them to their stake, and you have created a criminal. Suddenly everything that was off the table when that child had a stake in society is now on it. Drugs, stealing, prostitution, robbery, murder and every crime you can think of. Fraternal organizations, Scouts, churches, Synagogues, etc… all have a function, or at least they did, now the government has muscled them aside and taken over that role with the government monopoly school system, with the result that no one believes they have a real stake in society. Passive measures like, a school voucher system and limiting government’s ability to interfere with cultural and social institutions, would go much farther than an unlimited number of police in limiting crime and societal upheaval.

Even in a very limited constitutional government we see that the elite in government must be actively policed. How absurd is it that in the US today, a politician who wants to balance the budget and return to Constitutional government, is called radical!?!?! Only in revolutionary times would such a thing go past our noses without at least a sniff. The offices of every congressperson, senator, judge, bureaucrat, appointee, diplomat, etc… should be equipped with full video and sound, recorded and available to the public both on demand and live streaming on the internet. Any infraction of any law would bring instant enforcement action through a Fourth Branch. The Fourth Branch would be given power sufficient to try even the Alger Hiss’ of the world, without reprisals, teeth to punish them and eyes and nose to detect any hint of corruption.

Limited government, laissez faire free markets, returning to a society that embraces morality, individualism, innovation and risk taking are the hallmarks of my vision for a better government, economy, culture and society. One that is limited and so doesn’t limit anyone’s potential, is based on free market principles so the people can be affluent, is moral so the laws need be few and enforcement rare, individualistic people to beware of those peddling tyranny in a bunny mask and finally, innovative to advance our technology, understanding of God’s universe and ourselves. In short government should not be in the way. Anyone who reads the entirety of my work will quickly grasp the subtleties of such a government, why I have concluded it is nearly ideal and how to implement it. Any country that adopted these ideas would very quickly become a power house, economically, militarily and have a wealthy happy people.

Limited Government or Usurpation

Dear Friends,

It seems to me, what limit to the law if the lawmakers are not held to it, furthermore, if the lawmakers do not follow whatever constitution they are supposed to, then what limit on government? Law then must become mere usurpation and government must serve the elite not the people. It is a self evident fact that when a class serves only it’s own narrow interests, economic destruction ensues, social upheaval follows and violent revolution comes shortly after. History is unambiguous about this. In fact, there are names for the various wrong forms of government enumerated by Aristotle, Tyranny when a monarch serves only his own interests, oligarchy when the aristocracy (elite) serve themselves and democracy when the polis is tyrannical. Everyone is served best when everyone serves everyone.

The class warfare theory of human history is undeniably false, at least as it pertains to economic classes since most of human history has seen tension between factions of the elite, and only rarely between the elite and the people, but when class is defined as faction then it holds some truth. Faction is like fire, it consumes a nation, leaving it in ashes. Every great nation, city state and empire has seen this happen to it. At the outset all the people work together to build a great society. Once the society has been built, the people split into factions, each vying for themselves. The more prosperous the nation becomes the more factious the people become. Naturally, the faction that has the most power is the one to come out on top, these are almost always the lawmakers.

Those who write the laws may be the people as in ancient Athens, the aristocracy as in Venice or a monarch as in feudal Europe, but in all cases there is a defined group that writes the law. When a monarch writes law that benefits all of society, that society flourishes, and when he or she writes laws to serve him or herself, then the country crumbles. The same holds true if the lawmakers are a class, faction, heirs, elected or appointed. The type of government is also irrelevant. Monarchy can have liberty, private property and prosperity while democracy can be illiberal, usurp private property and be filled with poverty. What generates wealth, liberty and prosperity is that the factions, classes and groups work for the benefit of the whole.

Lawmakers usually are not constrained in their actions. There is no overriding legal authority to hold them to their laws or constitutional limits, except the police and military, which they have total control of. If the lawmakers choose not to hold themselves to their own laws then why would they limit the law? They could freely use law to advance their personal self interests with impunity. Passing laws that move ever more of the national wealth into their own hands would be a snap. Money isn’t the only thing that can be usurped. If they sought sexual gratification rather than wealth then they could molest interns as they wanted, if they wanted to never be criticized they could pass laws to jail anyone who criticized them and if they desired godhood they could merely have statues made at the public’s expense and placed in city centers. If those who make the law are not held to those laws there is no limit to the usurpations they can engage in.

Constitutions were an invention to constrain those who write the law, but even under a constitution, if the lawmakers don’t hold themselves to it, no matter how well written, how insightful or how intelligent the framers were, it is moot. Since people are usually unwilling to hold themselves to a rule that limits their self interest, especially egoists, then constitutions cannot function alone. To argue those who make law are somehow not human but angelic is to argue up is down. Especially in the light of past human governments, where the lawmakers were not held to their own laws, or indeed the constitutions that were designed to constrain them. Until the lawmakers are forced to follow every law and letter of the constitution, there can never be real liberty, true prosperity, no one’s private property or person is safe from usurpation. Until there is a NUMA or Fourth Branch, creeping tyranny will ever hold mankind in it’s cold selfish clasp.

Argentina’s Election of Macri

Dear Friends,

It seems to me, Argentina is one profoundly corrupt nation, and that bodes ill for any possible economic prosperity. This isn’t news from the perpetual failure, Argentina, is no exception it is the rule. Argentina seems to have an ability to choose the wrong path as an intrinsic attribute. The corruption in it’s government is as legendary as is it’s economic failures. Argentina has become the poster child for everything wrong with modern government. Lately we have prosecutors found dead in their bathtubs, who have the audacity to write up criminal charges against the former President over collusion with Islamic terrorists from Iran to kill Jews, and is it a shock to anyone that the new prosecutor and the courts refuse to hear the case? Such endemic corruption would be unthinkable in a market based country, but Argentina is a socialist nation, and so such corruption is merely the way to do business, which is the future of any nation that chooses socialism. Argentina however, has just changed course, for how long no one can tell but electing a capitalist is a start.

In 1900 Argentina had the same GDP per person as the US. Since then Argentina has gone down the path to socialism in a big way. All governments like to hand out other people’s money, it makes the government appear generous without costing the elite that run it anything. Argentina has taken that strategy to a new level. Their healthcare system is open to anyone who needs healthcare from around the world. People flock to Argentina from all over South America to cash in on it which costs the Argentine people tons of money. The costs are paid for by the people through lower wages, lower standards of living and a shrinking middle class. The costs are born by the people and the benefits are given to the elite.

This year Argentina elected Mauricio Macri who ran on a platform of economic transformation. He claimed he will change the direction from socialism, which has failed so spectacularly in Argentina, to laissez faire. We will have to wait and see if he does, but that the Argentine people elected someone who will change course from socialism to capitalism, is encouraging. With it’s history of socialism and the outright destruction of the middle class through many bouts of hyper inflation is worry some however. It shows the people of Argentina will likely be expecting an immediate economic miracle, which after so many years of corruption and economic absurdity, will inevitably be slow, especially since Macri will have to fight against the entrenched bureaucracy.

The corruption became even more evident after Macri’s election. The record office had a suspicious fire, which destroyed all the records of who is owed what from the Argentine government, as well as all the pay offs and corruption of the last regime. Convenient eh? Then dozens of armored trucks left the Central bank will all the Argentine gold reserves and foreign reserves delivering them to waiting airplanes to be whisked out of the country to private accounts only God knows where. Such shenanigans highlight the results of socialist governments. Socialism is not for the benefit of the people but for the elite. The elite live like kings while they steal everything that is not nailed down.

The endemic corruption within the government will not just go away because a new president has been elected, it will need to be dug out and excised, like the cancer it is. How such a feat can be done with people who are corrupt themselves will be an enigma, unless Macri can somehow get the government and people to agree on a Constitutional amendment that establishes a NUMA. Drawn from people outside government such a branch could effectively root out the corruption that has so hobbled Argentina. Anything short of a NUMA would be smashed against a wall of corruption decades in the making.

Argentina has a long hard road ahead of it to get their economy and government functioning again. The new President Macri is facing an entrenched bureaucracy that will try mightily to stymie his every effort at reform, corruption in every nook and cranny of the government, a people anxious for results, and a media that is at best hostile to his reforms. He does have the benefit however of presiding over a nation that is rich in natural resources, has good access to the ocean, has an educated people willing to work, and fairly good infrastructure. We should pray for the people of Argentina, that Macri’s reforms do the trick and that Argentina puts its socialist past behind it. Not just for the Argentine people, but as an example for all the people in poor countries beset by socialism and corruption.

Good Intentions, Bad Ones, and Avarice… the Road to Tyranny

Dear Friends,

It seems to me, the road to hell is paved with good intentions, bad ones and avarice. Through a sense of altruism, watchers will want to help those they watch, more than they can now, because to do that they always need more power, when they get that power, they find it is insufficient and so… thereby advancing inevitably to tyranny. Tyranny doesn’t require as a prerequisite, malevolent thought, not at all, tyranny can arise from perfectly altruistic intentions. Each man and woman having different tolerances for despotism will wake up and find themselves in tyranny sooner or later, but all eventually will, once it has got too late.

In our modern surveillance state there are watchers, this is a new fact of life, and if they have a sense of compassion, which is a perfectly human quality, those they watch will become like pets, to be protected, nurtured and fed. Imagine having a beloved pet and you can only splash water at it’s dish? Wouldn’t you want the power to pour water directly into it’s dish? Now that you can pour water directly into it’s dish, shouldn’t you have the power to clean it? Isn’t it cruel to force it to drink from a filthy dish? You could minimize the violence it faces by collaring and leashing it. It would get the benefit of not fighting as much and the wounds that come with fighting.

When the watchers have no one to watch them their other human traits come to the fore. Vice, avarice and opulence creeps into the lives of the watchers, with no immediate direct negative consequences, because they are above being watched. No matter if it is personally immoral, socially immoral or just plain uncivilized behavior, the whole of the nation must suffer when the watchers become corrupt. Like a volcano spewing lava from the top, society vomits corruption from the top, and it oozes from the top down, covering the rest of the mountain in due time. Once corruption has reached the lowest echelons of the bureaucracy, you know every inch is saturated.

Our watchers have no one to watch them, the proof is where there have been attempts to limit the actions, even in extreme cases, the watchers have marshaled their political power, through their unions, the political faction that derives it’s sustenance from those unions, the judicial faction that sees our Constitution as liquid, and the unbiased media… to push back those limits. During the financial crisis of 2008, it was discovered that the very people who were supposed to watch over the banking system, were instead, watching porn. When it came out that they were derelict in their duty, their right to watch porn instead of work, was upheld in the arena of political power and they enjoy their right to watch porn at work today.

Which presents us with a second means a watched society can devolve into tyranny, if the first is through a sense of compassion, the second through corruption, and a third a sense of superiority. Sitting in a dark cubicle watching the comings and goings of other people, all day and all night, either directly or indirectly using meta data, can only lead to a sense of superiority. If I am setting there watching some person make the same mistakes over and over, even if I make those same mistakes myself, gives me a sense of superiority. That is human nature.

A sense of superiority dehumanizes those the superior person oversees. They become less than a human being in his or her eyes, they may be beloved pets, chumps to be fleeced or maybe just an ant farm. If you are overseeing an ant farm, you want your ant farm to be bigger than other people’s, don’t you? That would be the goal of an ant farm. So you would do everything you could to make your ant farm bigger. You might find a better medium for the ants and so transfer them into the better sand. They might outgrow the terrarium so you might move them to a larger terrarium. Maybe, you could add some plants for your ants to crawl around on, because it amuses you to watch them crawl around plants.

There is no possible way a system where there is a caste of people who watch the rest of society, enforcing every law, rule, regulation, either civic, social, or criminal, at every moment of the day, everywhere… that doesn’t lead inevitably to despotism and is itself tyranny. If the watchers were computers, programmed to watch everyone, all the time, no matter where they are, would remove the human element. But that would not be acceptable to the elite, who make those laws, rules and regulations. Such a system would enforce their own rules on the elite, which is unacceptable, so they need a group of humans to stand in the way. But even a cursory look at a computer driven system, shows it is utter tyranny of the highest order, it’s one redeeming feature is that even the elite would chafe under it’s provisions, showing that while not being liberty itself, it would lead to liberty in short order.

While the benefits of being watched over, might seem like a good thing to some people, random violent crime would become regular, plenty of soylent green for everyone, parks to crawl around on, everyone could live in Cabrini Green, a vibrant vice economy would employ many, etc… the inevitable tyranny that would result isn’t as rosy. No matter the nature of our watchers, and the likelihood is that every type will be represented, it will initiate a slide to tyranny that will be hard to stop. A Fourth Branch, or NUMAfourth branch, might mitigate the negative side so we could get some of the positives, but that is for another blog. The takeaway point of this article, is that a system where some watch others is a path to tyranny, no matter if the watchers are virtuous or villainous. The road to Hell is paved with good intentions, bad ones, and gluttony.

Solving Ukraine’s Problems

Dear Friends,

It seems to me, Ukraine’s situation is rapidly deteriorating, impoverishing it’s citizens and pushing the breakaway areas with war and the threat of war. What a sad state of affairs for people who, because of their geologic location, have taken it on the chin over and over. The political system is broken beyond repair with whomever is in power crushing any opposition at will. There is no effective protections for freedom of speech, assembly or conscience. The people of Ukraine deserve much better. Every nation on the planet could learn a thing or two, how not to run a country, from Ukraine’s example. There are answers to the thorny problems Ukraine faces, but unfortunately, real solution are being ignored for war and arbitrary power.

Ukraine’s history is one of invasion, violence and tyranny. From the dawn of history Ukraine has been invaded by empire makers. The Mongol invasions were particularly hard on the people, with whole cities raised to the ground, every man woman and child killed, even the dogs, cats and livestock! Tamerlane slaughtered the Ukrainian people with the glee of a demon. When the Soviet union controlled Ukraine, Stalin stole the food the Ukrainians had grown themselves, selling it on the world market, starving to death millions of human beings! The poor Ukrainian people have suffered for centuries under the heavy hand of sadistic invaders and despots. It is past time for those sturdy people to have a measure of freedom and prosperity.

President Petro Pososhenco continues in the footsteps of the man he deposed. Instead of ushering in an era of peace and prosperity he has turned to war and autocracy. While it is only human to want revenge for grievances suffered, when a politician does it, the lot of the whole people is lowered. Today the Ukrainian central bank is broke with all of Ukraine’s gold stolen. The war with separatists sporadically flaring up, and now with US lethal aid going to Ukraine, the likelihood of a shooting war with Russia becomes a real possibility. Crimea is lost to Russia, for now, and the Eastern cities are in the hands of separatists, which would be a blow to any sovereign nation. Sadly, Ukraine is used to blows, and is likely punch drunk.

A better option, in my humble opinion, would be to sign a peace accord granting the breakaway areas autonomy, as long as they don’t formally become part of Russia. This would stop the bleeding, both of human blood and economic red ink. War is never a good option especially when there is an alternative. Of course it take two for peace and only one for war, with the Russian Ruble in free fall, the Russian people looking at hyper inflation and the Russian economy collapsing, war becomes more probable, since war is a traditional way to make patriots of starving people. Nothing rallies a people like a rip snorting war. Granting the breakaway areas autonomy would take the possibility of outright war off the table.

The next thing Ukraine should do is get their political house in order. To that end, I have advocated for all nations, including Ukraine, a NUMA or Fourth Branch. It would chain the lawmakers to their own laws and Constitutional limits. Of course the Fourth Branch option would require a Constitutional rewrite. If done right such a rewrite would have many beneficial effects. The US Constitution should be the basis of any new Ukrainian Constitution… with the addition of a NUMA. A Constitution that strictly limits the role, scope and power of government, would allow the free market to do it’s thing. For a better explanation see an excerpt from my last blog here.

If these two things were done Ukraine’s economy would start flourishing. The Ukrainian people are smart, hard working and risk takers, all of which are essential to a rapidly growing economy. Until the war is ended, and the government retreats to it’s rightful role, the Ukrainian economy cannot possibly get on solid footing. If the economy of Ukraine becomes dynamic, the gross domestic product per person would skyrocket, or in other words, the Ukrainian people would see prosperity they could have only dreamed of before. Once that happens the breakaway areas will almost certainly petition the Ukrainian government to allow them back in. Self interest trumps all other considerations. Ukraine could slowly rebuild itself without the exigencies and ruin that protracted wars always bring on. This would be a peace and prosperity based solution to the fundamental problems of Ukraine. Wise leaders would take the path of peace and prosperity, while foolish ones, war and poverty… Let’s pray the leaders of Ukraine are wise and not foolish.

On The Riots In Ferguson

Dear Friends,

It seems to me, the fundamental reason there are riots on the streets of Ferguson is the deficiency of clear knowledge of what really happened, magnified by the lack of a fair process for the redress of grievances. That lack of redress could be effectively addressed by the Fourth Branch’s Consumer Protection Bureau, and the lack of transparency, which was the first cause of this unrest, would have been solved by the Executive Ombudsman’s office. All the lives that have been lost, the businesses destroyed and future profits erased, money spent by government to police the uprisings, repair the damage and heal broken bodies, all of it would have been avoided had we had a NUMA. So much of what is wrong with our world today would be resolved, if we only could spread the news about the potential of a Fourth Branch, and then actually succeed in enacting one. Our standard of living would increase every year regardless of the political winds.

The spark of the conflict in Ferguson is the lack of knowledge of what actually happened that night between that officer and that unarmed man. Even the fuel of anger in the air, well above the lower explosive limit, came about because of the lack of transparency magnified by a lack of redress. Everything beyond that point in time is dependent on that lack of clear knowledge. If the police shot the unarmed man, (regardless of his skin color), while the man was pliant and not aggressive, the officer who pulled the trigger must be charged with, at the least manslaughter, and potentially murder one, if the crime was premeditated and so forth. If however, as the grand Jury found, the police officer shot in self defense, there should be no charges and the officer should be reinstated with all benefits and back pay without prejudice. Anyone who disagrees with either of these two possibilities is unreasonable, their opinion is based on prejudice and not on reason, to them there is no conciliatory logic.

So the basic problem is the lack of clear, unambiguous knowledge of what really happened, that everyone can agree on. If Darren Wilson was wearing a camera that night, recording everything that went on, and the video was available for anyone to see, there would be no reason for the protests, except as a violent means of sedition. One of the basic tenants of a Fourth Branch, or NUMA, would be that everyone in government would be monitored at all times, (like the checkout girl at Walmart). Internal Affairs in police departments would be handled by the state NUMA. More specifically, the Ombudsman of the Executive’s office, would monitor the Executive branch and all it’s employees. The police would be equipped with body cameras, turned on at all times when they are on duty, to protect them and the public. National police like the FBI would be similarly equipped using the same practices. Every interaction with the public would be available immediately upon request of any person involved or at the request of the Consumer Protection Bureau of the NUMA.

If someone had a disagreeable interaction with the police, or their son or daughter was, God forbid, killed, in an interaction with the police, or any other agency of government, that grieved or even an involved person could file a complaint against that officer, department, or agency, and the complaint would be looked into by the Consumer Protection Bureau. The complaint would get sent to an adjuster who would make the initial investigation within a month. After the initial investigation, if cause was found, the case would be assigned to an investigator, otherwise the results would be posted on a government website set up for that purpose. A case that gets appointed to an investigator would be exhaustively investigated, all the findings would become public record available on a government website, free of charge. If the investigator found cause for criminal proceedings the offender would be prosecuted to the full extent of the law.

Since the fundamental reason for the riots was a lack of clear knowledge, and a NUMA would have provided that clear knowledge, as well as a fair mechanism for redress of the grievances of family and friends, we can safely reason that if there was a NUMA in place in Missouri, this whole violent, expensive and bloody affair would have been averted. The lives that have been lost would not have been lost, the human beings wounded need not have suffered nor lost the use of limbs, the property destroyed would be available to enhance someone’s life, the businesses razed would still be providing paychecks to hard working people and the money not spent could be used to cut taxes, harden our electrical grid against solar flairs and EMP, provide incentives to entrepreneurs, or a whole host of other things to improve the lot of humanity, instead of on trying to get back some of what was lost. This is just one example of how a Fourth Branch, or NUMA, would make our lives better. How many more can you think of?

The Honor System

It seems to me, the political elite only pledge to follow our various Constitutions, but are not forced to. This is nothing more than an honor system. To place such responsibility in the hands of so few without any real oversight, is not only dangerous, but it is unfair to them. The lessons of history are unanimous about this. Every nation, republic, democracy and empire has fallen due to corruption. Corruption stemming from both basic human nature, (self interest), and political favor. The fundamental problem in Ukraine that led to the loss of Crimea to Russia, was government corruption, the poor performance of the economy despite huge the energy reserves of Russia, is from government corruption, the present constitutional crisis in the US, is from government corruption… the list is endless. The point is, to change the paradigm to one that actually works in the interests of the people and the elite, is to force the political elite to follow the limits placed on them, in our Constitutions. Lacking that fundamental shift in governance, we can expect to see history repeat itself over and over again, resulting in war, unrest, famine and poverty.

 

Imagine a society where there are laws but everyone is on the honor system to follow them. The deaths simply from traffic accidents would be daunting. No one would be safe in their own home, unless they went to extreme measures to protect themselves, and people would have to. Our children wouldn’t be safe on the streets, far less safe than they are now! Moreover, the market system could not function under such a regime. Such a system would ring in epic poverty and famine. Everyone reading this article knows and understands this fact, but people are so brainwashed by the elite that as soon as I bring up a constitutionally empowered police of government, people have a visceral reaction against the idea.

 

The spurious arguments flow like a torrent. Some include… “it would be too expensive.” So, it isn’t too expensive to intrusively monitor three hundred million people to the nth degree, but it is too expensive to monitor a few thousand? “More bureaucracy is not the solution,” this ignores the fact that bureaucrats regulate every aspect of our lives, and grows like a kudzu vine strangling our economy and freedoms, but if government were held to Constitutional limits, the existing unconstitutional bureaucracy would have to be scaled back. “They would just get corrupt themselves.” This is the most pernicious argument for allowing the elite to continue in the honor system, crushing our liberty under the jack boot of government corruption. To believe that a Fourth Branch would necessarily become corrupt, one has to believe the local police, the State police and every other law enforcement agency is also utterly corrupt. If someone believes that, they must necessarily believe those agencies should be disbanded, putting the whole of society on the honor system.

 

Human nature is self interest. The market system twists our self interested nature into being rational maximizers, (civilized people). The difference is that a rational maximizer understands that his or her self interest is tied up in everyone else’s self interest. Our basic nature, (barbaric nature), is to follow our immediate self interest regardless of the consequences to society and others. The market system and American ideals have taught humanity the truth of Socrates argument in The Republic. That lesson is lost on those with political favor, because their self interest can be met outside of the market system simply by perverting it into it’s evil twin, crony capitalism. This is furthered by the corruptible elite who are also prevented from being rational maximizers by the lack of any real oversight.

 

There is not a nation on the face of our planet that would not benefit from policing the political elite. Even socialism would work better if it had a Fourth branch policing the actions of the political elite. Since the beginning of time people have sought ways to limit the political elite’s propensity to pervert government to their own self interests. Constitutionalism is a relatively new phenomenon. It has had limited utility because the political elite are still on the honor system. Once the political elite cannot use their offices for personal gain, without facing the imminent fear of prosecution and jail, government will shrink back to it’s Constitutional limits, the people will be prosperous and crime will dwindle. A Fourth Branch is a win win for society, culture and even government itself. The real winners however will be us, the people, stable government is a boon for everyone.

Crime, Incentives and the Elite

It seems to me, a lawmaker who doesn’t subject himself to his own law, is like a cook who won’t eat his own cooking. In the case of a cook this can lead to gastrointestinal distress, but in the case of a lawmaker, it leads to economic depression, rising crime rates, societal breakdown and eventually tyranny. The negative consequences of a lawmaker who refuses to follow his or her own law is very much more dangerous than a careless cook.

Not only today but throughout human history we see that lawmakers are loathe to follow their own laws. Thrasymachus said it best, the great men among us only seek to appear just while being unjust. He thought that in order for society to work, the people must be just in action, but the powerful among us need not be. Harry Truman had a saying for this type of politician, “Anyone who gets rich in politics is a God damned crook.”

No greater incentive can be foisted on society to break the law than when we look up at our leaders and they don’t follow the law themselves. They break their own rules and get rich doing it. Until recently, a legislator in the US could engage in insider trading, without breaking the law. You or I would be prosecuted to the full extent of the law for that. Yet those that made that law refused to be subject to it, because to be just and follow their own law, would hamper their ability to get rich in politics.

Confucius said that people follow their leaders. If those leaders are corrupt then we will follow them into corruption and when they are virtuous we will follow them to virtue. This seems like a self evident fact but is lost on most of humanity. We look to the Elite for guidance in what is a good life. Then we emulate them in their choices. We go where they lead us.

A few examples of the Elite leading us astray are, a vice President caught blatantly violating campaign finance laws saying, “There is no overriding legal authority,” the Treasury secretary caught cheating on his taxes, rampant vote fraud, constant coverups, those lawmakers who are a broken radio calling for higher taxes chiseling on theirs, a Legislator for hire caught with cold cash in his freezer, the President sending guns to Mexican drug lords and vilifying honest legal gun owners for it, coupled with untold sex scandals.

This is why we see so much disease in our societies. Divorce is rampant, abortion is so common… Planned Parenthood, (An ironic name if ever there was one), murders a baby every ninety seconds, school shootings fill the news, drug use is rampant and there is not a community that hasn’t seen an epidemic rise in embezzlement. These things are all results of us following our leaders. We have become miscreants just like the people who make our laws.

That is why the Elite need to monitor us with such intrusive measures. Our streets are filled with video cameras, our emails and tweets are stored on a government computer, (how long until they are opening our mail), the unbiased media is filled with calls to outlaw the Second Amendment to the US Constitution, in fact, the Constitution itself has become despised by those very people who are supposed to be bound by it! This must be done because we have emulated the Elite too well.

Our liberties are threatened at every turn while the Elite accept less and less controls on their actions. It is getting so out of control that people, on both the right and the left, are talking about armed insurrection! This is pure childishness! The answer is not violence, it is to monitor the Elite, and force them to follow the Constitution as well as their own laws. Until we do that our society and civilization will continue sliding into the abyss of oppression. We have followed those reprobates and have become reprobates ourselves. God help us if we slide much further. This is no mere bellyache… It is an assault on us, our society and our rights. Isn’t it about time for a NUMA?

If I Were Dictator of Greece..

It seems to me, if I were made dictator of Greece for one year , I would implement a much better plan to fix the economy than anything I have seen yet. The stakes are huge but the Elite are playing the lute while Athens burns. The instrument is socialistic demand side fixes, that have been proven to fail, every time they are tried. Meanwhile… circumstances change for the worse, daily. Greek GDP is falling off the table. The situation requires drastic action to stem the economic blood loss, and to, change the trajectory of the debt to growth ratio. Your 401k and retirement are directly threatened by this state of affairs even if you haven‘t invested in Greek or European debt. When it explodes, the Elite will not take any loss, you will, look at MF Global, the Elite will simply raid our accounts to pay themselves off… Then weep how bad the feel that they had to do it! Bankruptcy is coming anyways so get it over with. The next thing I would do is eliminate all taxes… At this point, the societal myth of Greece is such that, the Greek people will not pay taxes. As a result of this pernicious situation, everyone is a criminal, since no one pays all of his or her taxes. This creates a corrosive attitude to government and morality that enables dependency and undermines productivity. Since taxes are not paid anyways, eliminating them would serve as a means, to raise some of the underground economy aboveground and produce economic growth.

Taxes would be replaced with import duties on all goods. An equal duty of ten percent put on all imports would be the maximum I would institute. This would only last until the new Constitution was ready and the reset is complete. Then the import duties would be eliminated and replaced with a consumption tax. Income based taxation would be Constitutionally prohibited. All taxation would be maxed out at ten percent Constitutionally. This would hold the new government to an actuarially predictable limit.

All second pensions and pensions to persons under fifty years of age would be immediately eliminated. The entire dependency ethos would be questioned in a advertising campaign across all media. The contrast between someone working daily, while someone else, the same age, plays bocce ball on the beach collecting their parent pension, would be highlighted. I would use every means to inculcate to the people the necessity of being productive. School children, in Greece especially, should read Plato’s reflections on Socrates. The ethos that Socrates propounded was as productive and morally responsible as any. The fact that Saint Thomas Aquinas, one of the doctors of the Church, included the teachings of Aristotle in the cannon of the Church, shows the moral truth of the philosophy. The uplifting stories of Horatio Alger should be included in every school children’s reading around the World.

The next would be to eliminate all bureaucratic regulation while keeping all legislatively founded laws. Regulation, permitting and licensing would be gone. Historic protections would be the only bureaucratic regulation kept. Bureaucratic regulation creates an atmosphere of molasses for the economy. Regular law would be kept and enforced. Criminal law especially would remain because it would be the acme of insanity to eliminate it.

The elimination of bureaucratic regulation would be a huge supply side stimulus to the Greek economy. This supply side stimulus would necessarily generate jobs and economic growth. As people start businesses they have been thinking about for years, there would be creative destruction, with the resulting economic efficiency and productivity increase that follows. These two things alone, eliminating bureaucratic regulation and all taxes, would create the conditions for GDP growth over seven percent, even staying within the Euro zone.

Next, I would set up a new Constitutional panel of ten people, (none of them communists or socialists), using the US Constitution as a model… I would, of course, add a NUMA or Fourth Branch, to it. This new Greek Constitution would limit the power of the Elite as much as realistically possible. Openly avowing, in writing, it’s antipathy to the welfare state and regulation produced by bureaucracy. The last thing would be to, have elections, reset the government, and step down. Go on a trip around the Mediterranean for a few years. Maybe visit Lydia and Sparta.

The path the Elite in Europe and Greece are taking is not working. Clearly it will not lead to a good outcome for anyone. Moreover it puts the World’s economy at risk. Bankruptcy is coming sooner or later, the only question is, how big will it be? Every tranche of money the IMF piles on makes the eventual fall bigger. The Elite, however, are of the opinion that they should do whatever is the easiest thing to do… Keep bailing Greece out. Like a lemming that runs in the middle of the stampede. It has no concept of another thing to do. It just runs. No way that could ever go wrong… Right?
